Work Permit Clearance and Residence Permit: what happens if the employer changes? Welcome to a new episode of the “Immigration Law” podcast.
I am attorney Fabio Loscerbo, and today we are discussing a recent decision issued by the Regional Administrative Court of Emilia-Romagna concerning the conversion of a residence permit from internship status to subordinate employment, with a particular focus on the Italian work permit clearance, known as the “nulla osta”. The case deals with a very common issue in immigration procedures: what happens when a foreign worker receives a work permit clearance for one employer, but then starts working for a different company. In the case examined by the Court, the foreign national had obtained the work permit clearance for the conversion of the residence permit and had signed the residence contract with a specific employer. However, he later began working for another company. As a result, the Police Immigration Office in Forlì declared the application for the work residence permit conversion inadmissible. According to the Administrative Court, the work permit clearance is strictly connected to the employer who initiated the administrative procedure.
For this reason, especially in the initial phase, there must be consistency between the employer requesting the clearance, the residence contract, and the actual employment relationship established with the foreign worker. The judges also explained that this interpretation aims to prevent abuses of the immigration system, particularly situations where procedures are started without a genuine intention to hire the worker. However, there is another important aspect.
The Court emphasized that the applicant had failed to provide any concrete explanation regarding why the original employment relationship had never actually started. And this is often the key legal issue in these cases: documenting the reasons behind the change of employer, proving continuity of employment, and clearly explaining what happened during the administrative process.
