Is it even legal for a legal immigrant to get a mortgage in the United States? Yes for most legal statuses — but which doors are open depends on your rung of the status ladder. Part 2 of Status: Approved walks all 11 rungs in plain English — citizen, U.S. non-citizen national, green card, COFA, work visa/EAD, refugee/asylee, TPS, DACA, asylum-pending, ITIN, foreign national — plus the rulebooks (ECOA/Regulation B, FHA Mortgagee Letter 2025-09, VA Title 38, USDA's "qualified alien" list, Fannie Mae/Freddie Mac "legally present"), Texas SB 17, and the two bills in Congress that would redraw the lines. Rules as of October 2026.
In this episode:
- The cold open: "Is it even legal for me to get a mortgage?" — the short answer and the long one
- The floor of rights: ECOA and Regulation B §1002.6(b)(7) — a lender may consider status for repayment, never your national origin; the 2023 CFPB/DOJ warning on blanket denials; the CFPB complaint path
- The teach segment: statute vs. agency rule vs. lender overlay — ask which layer said no
- The status ladder: all 11 rungs, the documents that prove each, and the doors each opens today
- FHA: 24 CFR §203.33's ability-to-repay logic + Mortgagee Letter 2025-09 — HUD's reasoning, the criticism, and the ICE data (5.8% → 0.1%)
- VA: earned by service under 38 U.S.C. ch. 37 — non-citizen veterans qualify; USDA: "qualified alien" under 8 U.S.C. §1641
- Fannie Mae/Freddie Mac: the "legally present" standard — and no repurchase solely for a post-closing status change
- Texas SB 17 (2025): designated countries, the exemptions (citizens, green card holders, sub-1-year leases, the homestead carve-out), Wang v. Paxton, and what it does NOT change about borrowing
- Where it's moving: the Gill bill (H.R. 9514, citizens-only) and the Housing Stability for Dreamers Act (H.R. 3472) — both proposals, neither is law

Be honest — should a person working here legally on a visa be able to get the same FHA loan as anybody else, or should federal loans be for permanent residents only? Tell us in the comments.
