On December 30, 2023, Special Counsel Jack Smith filed an opening brief with the DC Circuit Court of Appeals, responding to Donald Trump's appeal of his motion to dismiss being denied by the DC District Court. Trump's motion to dismiss asserted that he was immune from criminal prosecution for acts committed as President.
Smith's briefing addresses the arguments Trump brought in both the original motion to dismiss and his appeal, and serves as an opening briefing to the oral arguments currently scheduled for January 9, 2024.
