In 2023, the Parliament enacted The CEC and Other ECs (Appointment, Conditions of Service and Term of Office) Act, 2023, codifying the law on the appointment of Election Commissioners.
However, the Act was challenged in the Supreme Court by Congress Leader, Jaya Thakur on the ground that it violates the Court's judgement in Anoop Baranwal, making appointment to Election Commission dependent heavily on the executive.
