Former Deputy Eddie Duran, charged with manslaughter in the shooting death of Airman Roger Fortson in claimed self-defense, was provided a three-day self-defense immunity hearing in the first week of August—essentially a mini-trial in which the state bears the burden of disproving self-defense by clear and convincing evidence.

On Friday, September 11, Judge William Stone issued a rather shocking 34-page order denying the sought immunity and ordering that Duran continue to trial.

That order is what we’ll be breaking down today—and it’s the same order that compelled Duran’s defense attorneys to immediately file the following Monday a motion to have the judge recuse himself—which was promptly denied--as well as, on Friday, September 18, an interlocutory appeal to seeking a writ of prohibition essentially ordering the trial judge to grant immunity to Duran.

On September 22, just two days ago, the District Court of Appeals has ordered the State to provide their response to these motions by no later than 5 PM today, September 24.

The defense has also requested a stay of the trial proceedings while the DCA considers the merits of the stay of prohibition, given that otherwise jury selection for this trial begins this Monday.
