Welcome to the very first episode of AARO Voices, a new monthly podcast series from the Association of Americans Resident Overseas!

If you're an American living abroad, you know that life between two countries comes with unique challenges. At AARO, we've been advocating for Americans overseas since 1973, and we're excited to launch this podcast to share valuable insights that matter to our community.

Each month, AARO Voices will explore topics that affect Americans living abroad. For our inaugural episode, we're tackling banking—a pressing issue that touches nearly every American expat. Whether you've faced account closures, struggled to open new accounts, or dealt with the complexities of maintaining financial ties in two countries, you're not alone.

    Canaries in the Mineshaft: Are Americans Abroad an Early Warning?

    Are Americans living overseas the “canaries in the mineshaft” when it comes to the constitutional rights of American citizens?

    In this episode of AARO Voices, Gary Zuercher explores an idea presented by Fred Einbinder, Associate Professor at the American University of Paris and Vice President for Advocacy of AARO.

    Fred argues that Americans living abroad can provide an important perspective on broader questions about fundamental rights. Americans overseas face distinctive issues involving citizenship-based taxation, FBAR and FATCA reporting, banking and investment relationships, voting and political representation, passports and travel, financial privacy, and the transmission of citizenship to their children.

    The episode examines Fred’s comparison with concerns expressed by American colonists more than 250 years ago—including taxation, bureaucracy, economic restrictions, heavy penalties and political powerlessness—while recognizing that the circumstances today are very different.

    The discussion ultimately asks several fundamental questions: What rights belong to Americans simply because they are citizens? Should fundamental rights depend on where an American lives? How much power should administrative agencies have? And when can financial penalties or administrative requirements come into tension with individual rights and due process?

    Perhaps, as Fred suggests, Americans abroad really are the canaries in the mineshaft.

    In this episode of AARO Voices, we explore the growing impact of FBAR enforcement and FATCA on Americans living overseas—and why reform is urgently needed.

    Originally designed to combat offshore tax evasion, these laws increasingly affect ordinary expatriates managing everyday financial accounts in the countries where they live and pay taxes. We break down how FBAR (Foreign Bank Account Report) requirements work, including the $10,000 reporting threshold and the severe penalties that can apply—even for non-willful violations.

    We also examine the real-world consequences through the case of United States v. Tuncay Saydam, where penalties exceeded $544,000, raising critical questions about how “willfulness” is defined and enforced.

    On the FATCA side, we discuss how global reporting requirements imposed on foreign financial institutions have led to unintended challenges for Americans abroad, including account closures, denied services, and financial exclusion.

    Finally, we outline what expatriates need to know to stay compliant, and highlight AARO’s ongoing advocacy for reform—focused on fairness, proportionality, and a shift toward residence-based taxation.
