David Washington committed three brutal murders in Florida in 1976, confessed, and pleaded guilty against his lawyer's advice. At sentencing, his lawyer, overwhelmed by hopelessness, did little to investigate or present mitigating evidence about his character or mental state. Washington was sentenced to death, and later argued he had been denied the effective assistance of counsel.
Justice O'Connor, for the Court, set out the two-part test used ever since. A defendant must show that counsel's performance was deficient, falling below an objective standard of reasonableness, and that the deficiency prejudiced the defense, meaning a reasonable probability that, but for counsel's errors, the result would have been different. Courts must be highly deferential to strategic choices. Washington's claim failed.
Justice Brennan concurred in part. Justice Marshall dissented, calling the standard so malleable as to be useless. Washington was executed in 1984. Strickland claims are among the most frequently litigated in all of criminal law.
