  • Minter Ellison Wants Us to Reveal Our Sources | The West Report

    Simon Turner broke his back at BHP's Mount Arthur coal mine in the Hunter Valley in 2016. Ten years on, BHP has never filed a defence. He was being paid around $400 a week when his own paperwork put him on $137,000 a year, and a letter BHP sent Centrelink five years ago still blocks him from a payment today. He has been in hospital. He has no money for food.

    Last month BHP and its lawyers Minter Ellison pulled Michael West Media into court over the case, threatened us with BHP's costs, then dropped it after we filed a strike-out application. Now the same firm has come back with a defamation threat on behalf of a different client, demanding we reveal our sources, and has aimed it at our 23-year-old reporter Stephanie Tran as well as Michael West.

    Confidentiality orders sit over most of the evidence, which is the reason this video says less than it could. Half the proceeds of Michael West Media's tenth anniversary night go to Simon Turner.

    This week's Scam of the Week rounds up five stories. The federal government commits another $4.6 billion to the Osborne shipyard, taking its total contribution to $8.5 billion for a submarine construction yard that still has no submarines in it. An independent Aukus inquiry hears that each submarine begins life carrying 650kg of uranium enriched to 93 percent, and Australia has no agreed plan for storing the resulting nuclear waste.

    Labor's national conference blocks a resolution acknowledging genocide in Gaza before it reaches the floor. Labor's own push to reform gambling advertising gets watered down to a narrow prime-time ad ban, weeks after the party banked more than $4 million from gambling industry donors.

    KPMG sacks a senior partner over the Lendlease audit leak scandal it initially cleared itself of. A supposedly independent news outlet turns out to be a rebranded One Nation Facebook page publishing AI-written articles under a fictional byline. And Australia's antisemitism envoy Jillian Segal tells a Royal Commission that UN Gaza casualty figures are inflated. She can't produce evidence for the claim, so Michael West Media asks the UN directly. Its office disagrees with her.

    Dr Mo Mustafa, a Palestinian-Australian ER doctor, spent months treating patients inside Gaza's hospitals while journalists were barred from entering. At MWM's 10th Anniversary Gala Dinner, he sits down with Doctor Matiu to explain why he started filming on his phone after an MSF colleague told him it broke the rules, and how doctors became some of the only outside witnesses to what was happening.

    He recounts a mass casualty night when the hospital ran out of beds, meetings with UK Prime Minister Keir Starmer and Australian Foreign Minister Penny Wong over a mobile hospital still waiting to enter Gaza, and the story of a nine-year-old girl who walked three kilometres carrying her three-year-old brother after losing the rest of her family. He also discusses a new antisemitism definition adopted by Australia's health regulator, and what it could mean for doctors who speak publicly about what they saw.

    The Newcastle Hunter Jazz Club has cancelled its 37th annual jazz festival after new ATO superannuation guidance left it unable to guarantee compliance for 334 musicians across 52 bands in a matter of days. Club president Murray explains the compliance window, the legal risk of bands performing without super details on file, and why a volunteer-run club couldn't meet it. A freedom of information request obtained by Michael West Media found the ATO consulted 161 people and organisations on the new rules, and not one came from the music industry. Musicians have technically been classified as employees under superannuation law since 1992, but the guidance offers no clarity for performers over 67 without an active super fund.
