  • The children of Uganda vs Their government at war : The cost of war
    2026/03/07

    For over two decades, northern Uganda was devastated by the conflict between the government and the Lord’s Resistance Army. During this war, thousands of children were abducted, forced to fight, or displaced, exposing them to extreme violence and exploitation.

    In this episode, we focus on a landmark case brought before the African Committee of Experts on the Rights and Welfare of the Child. The case examined whether Uganda had failed to protect children during the conflict and what obligations the state had under the African Children’s Charter.

    It raises a key question: when children suffer in armed conflict, how responsible is the state for protecting them, and what happens when that protection fails?

    This episode breaks down the Nubian Community v. Kenyan Government case, one of the most important child-rights and statelessness decisions in Africa.

    I explain how Kenya’s failure to recognise Nubian children as citizens led to generations being denied nationality, education, healthcare, and basic legal protection.

    The discussion walks through the facts of the case, the arguments raised before the African Committee of Experts on the Rights and Welfare of the Child, and why the Committee found Kenya in violation of children’s rights.

    The episode also unpacks what this decision means in practice; both for Nubian children and for states that use discriminatory nationality laws, and why the ruling matters far beyond Kenya.
