Colorado brokers should start re-grounding their fair housing compliance in statute and state law rather than HUD guidance.
With HUD rescinding multiple interpretive guidance documents and proposing removal of its disparate impact regulation, brokers can no longer rely on federal “how-to” explanations for gray areas. Instead, policies and daily practices should be reviewed against the Fair Housing Act itself, the Colorado Anti-Discrimination Act (CADA), and applicable local ordinances.
In many cases, Colorado law is broader than federal law, meaning state requirements will continue to apply even if federal enforcement priorities narrow.
We'll also discuss the recent "Dear Colleague" letter from HUD to the industry, which states that brokers can share crime and school data. Think this is a free pass to steer clients towards a better school with lower crime rates? It's probably not . Let's talk about it.
